MK rules unused internet data cannot be voided unilaterally
Operators must offer service options that let prepaid data remain usable without extra charges.
Mahkamah Konstitusi ruled that remaining internet quota already purchased by consumers cannot be canceled unilaterally by telecommunications operators. In decision No. 273/PUU-XXIII/2025 read out at the MK building in Jakarta on Thursday, the court said internet quota is an intangible asset that carries private property rights and must be protected by the state. MK partially granted a judicial review of Article 28 paragraph (1) of the Telecommunications Law as amended in the Job Creation Law appendix. Operators may still offer packages with or without rollover, but they must provide options that keep leftover quota active, including through accumulation, extension of active periods, transfer of benefits, or compensation. The case was filed by Didi Supandi, Wahyu Triana Sari, and Rega Felix.
